As this is a comprehensive tax reform, all companies are affected. The main changes concern the tax burden and the transition from privileged tax statuses to ordinary taxation, as well as new special forms and deductions in the area of patents and R&D.
The effective maximum profit tax rate (federal, cantonal and municipal) in the city of Zug will fall from 14.35 % to only 11.91 %. In the other Zug municipalities, the rate differs slightly.
The ordinary capital tax rate in the city of Zug remains unchanged at 0.0717%. In future, taxable equity capital attributable to qualifying participations, group receivables or qualifying patents will only be included in the calculation at a rate of 2%.
The tax privileges for holding, domiciliary and mixed companies, the abolition of which was the main reason for the STAF, will definitely be abolished.
There are two options for transitional measures in the Canton of Zug
The introduction of the patent box means that the net profit from patents and comparable rights is included in the calculation of taxable net profit with a maximum reduction of 90%.
At the same time, an additional 50 % deduction for research and development costs will be granted under certain conditions.
The relief limit was set at 70 % of net income (excluding income from participations and loss offsetting). This means that at least 30 % of net income must always be taxed properly.
In the canton, the partial taxation of dividends from qualifying participations will remain at 50% as before. With the direct federal tax, on the other hand, the partial taxation of dividends is increased from 60% to 70%.
The tax reform will lead to a reduction in the tax burden for all companies that have been properly taxed so far. For companies that have applied the maximum profit tax rate, the tax relief is around 23%.
